These Terms of Service ("Terms") govern your access to and use of the Chicken Road mobile application (the "App" or "Application") and any related services, content, and features (collectively, the "Services") provided by Chicken Road App ("we," "us," or "our"). By downloading, accessing, or using the App, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you may not access or use the App. These Terms are the official 'rules of the road' for your Chicken Road journey, designed to ensure a fair, safe, and enjoyable experience for all our users. Please read them carefully before you start your adventure.

1. Eligibility and Account

To use our App, you must be at least 13 years old (or the minimum age required by the laws of your country to use our Services without parental consent). If you are under the age of 18, or the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, untrue, or incomplete, or if you violate these Terms. Your 'Chicken Road' account is for your personal use only.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a single mobile device that you own or control, solely for your personal, non-commercial entertainment purposes. This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. This license is the key to your 'Chicken Road' access pass.

3. Prohibited Conduct

When using the App, you agree not to:

  • Use the App for any illegal or unauthorized purpose, or engage in, encourage, or promote any activity that violates these Terms.
  • Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App.
  • Circumvent, disable, or otherwise interfere with security-related features of the App or features that prevent or restrict use or copying of any content.
  • Use any robot, spider, scraper, or other automated means to access the App for any purpose without our express written permission.
  • Transmit any worms, viruses, trojans, or any code of a destructive nature.
  • Harass, abuse, stalk, threaten, defame, or otherwise infringe or violate the rights of any other party (including but not limited to rights of publicity or other proprietary rights).
  • Attempt to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the App.
  • Sell, rent, lease, or otherwise transfer your account or any access to the App.

Violation of these rules may result in suspension or termination of your access to the 'Chicken Road' and potential legal action.

4. Intellectual Property Rights

The App and all its content, including but not limited to text, graphics, images, logos, button icons, software, audio clips, digital downloads, data compilations, and the "Chicken Road" name and trademarks (collectively, "Our Content"), are the property of Chicken Road App or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted no right or license with respect to Our Content other than the limited license to use the App as set forth in Section 2. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of Our Content without our prior written consent. The 'Chicken Road' itself, as a concept within the game, is part of our creative intellectual property.

5. In-App Purchases (If Applicable)

The App may include options to make in-app purchases for virtual items or currency ("Virtual Goods"). All purchases of Virtual Goods are final and non-refundable, except as required by applicable law. Virtual Goods have no real-world monetary value and cannot be redeemed for cash or other goods or services outside of the App. You do not own the Virtual Goods but acquire a limited, personal, revocable license to use them within the App. We reserve the right to manage, regulate, control, modify, or eliminate Virtual Goods at any time, with or without notice. We shall have no liability to you or any third party in the event that we exercise any such rights. These purchases help us maintain and improve the 'Chicken Road' experience.

6. Disclaimers and Limitation of Liability

a. Disclaimers

THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE APP IS AT YOUR SOLE RISK. THE 'CHICKEN ROAD' MAY HAVE UNEXPECTED BUMPS.

b. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHICKEN ROAD APP, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE APP OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP OR SERVICES SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE APP IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100.00).

7. Indemnification

You agree to defend, indemnify, and hold harmless Chicken Road App, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, any use of the App's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the App. This means you are responsible for your conduct on the 'Chicken Road'.

8. Governing Law and Dispute Resolution

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of California, USA, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the App shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in Santa Clara County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. This defines the legal 'Chicken Road' for disputes.

9. Changes to These Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App. We'll make sure the 'Chicken Road' signs are updated for any term changes.
